General Terms and Conditions of Purchase
1. Purpose and generality
These General Conditions of Purchase (hereinafter, the “General Conditions”), together with any special conditions that may be established, regulate the conditions of purchase of products through the website www.olicatessen.com (hereinafter, the “Website” or the “Portal”), owned by Molí dels Torms SL. (hereinafter THE COMPANY), with CIF B2556679; with registered office at: Mestre Benet, 19 -25164 – Els Torms, Lleida; Email: info@olicatessen.com; registered in the Mercantile egister of Lleida, Volume 905, folio 100, page L17583, 1st Inscription and Health Register RSIPAC /RGS : 16.03553/L.)
The use of the services of the Website, as well as the acquisition of any of the products offered, implies the acceptance by the User, without reservations of any kind, of each and every one of these General Conditions. Registration on the Portal and its use implies that your data as a User will become part of the files of EL MOLÍ DELS TORMS SL, and its treatment will be in accordance with the provisions of the Privacy Policy, which the User expressly declares to know and accept.
EL MOLÍ DELS TORMS SL provides information about products and offers the possibility of purchasing them through the website www.olicatessen.com. People who intend to purchase products do not need to be “Registered Users” and can place an order by filling in the forms created for this purpose, for the materialisation of the purchase process and following the steps that EL MOLÍ DELS TORMS SL subsequently communicates through the Website.
These General Conditions, together with the Legal Notice, cookies policy and Privacy Policy of the Website, are the only conditions applicable to the use of the Portal and the purchase of products through it and replace any other conditions, unless previously agreed in writing between EL MOLÍ DELS TORMS SL and the User. Consequently, the User who accesses the Website, registers and purchases products through the Portal agrees to submit to and is bound by the General Conditions, the Legal Notice and the Privacy Policy as they are drafted at the time of accessing the Website.
Any User who fills in the order form or contact section of the Website must be at least eighteen (18) years of age.
2. Product information
The photographs, graphic or iconographic representations and videos related to the Products of EL MOLÍ DELS TORMS SL, as well as trade names, trademarks or distinctive signs of any kind contained on the Website, are intended to provide as much information as possible, however, the User must bear in mind that they are for guidance purposes and, consequently, are not exhaustive.
The sale of these products will be made to individuals and/or companies. EL MOLÍ DELS TORMS SL reserves the right to decide, at any time, the products offered to Users through the Portal. Thus, EL MOLÍ DELS TORMS SL may at any time add new products to those included in the Portal, it being understood, unless otherwise provided, that such new products shall be governed by the provisions of the General Conditions that are in force at that time.
Likewise, EL MOLÍ DELS TORMS SL reserves the right to stop providing access, at any time and without prior notice, to any of the products offered on the Portal.
In the event that, due to circumstances of force majeure, a product is not available after the purchase has been made, EL MOLÍ DELS TORMS SL will inform the User by email of the total or, where appropriate, partial cancellation of the order. The partial cancellation of the order does not entitle the User to the cancellation of the entire order, without prejudice to the exercise of the right of withdrawal that corresponds to the User in accordance with the provisions of these General Conditions and the legislation on consumers and users.
3. Product purchase system
To proceed with the purchase of the product, the User must select the product they wish to buy and add it to the Shopping Basket. Once the selection of products to be purchased has been completed, the User may continue with the purchase or click on the “Go to checkout” icon. Next, the products selected for purchase will be indicated and the User will be able to indicate if they have a discount coupon. They will have to indicate the shipping and billing details if they are not the same, and select between the different payment methods. Finally, the user must click on the icon “Place the order”.
Once the purchase process has been completed, EL MOLÍ DELS TORMS SL will send an email confirming receipt of the order to the email address provided by the User within the following twenty-four (24) hours.

The order confirmation sent by EL MOLÍ DELS TORMS SL will not be valid as an invoice, only as proof of purchase. The Customer Service Department of EL MOLÍ DELS TORMS SL will send the User the corresponding invoice within fifteen (15) days from the execution of the purchase.
Subsequently, the expected delivery time of the order will be confirmed by email.
For purchases in mainland Spain and the Balearic Islands, the minimum purchase unit is the product units.
For purchases from the rest of the European Economic Area countries, the minimum purchase unit is the box.

4. Product prices
Product prices displayed through the Web Site include VAT, as well as the shipping costs of the products on behalf of the buyer. Otherwise, they will be detailed and broken down in the “Your Basket” section of the Website.
EL MOLÍ DELS TORMS SL reserves the right to modify the prices shown on the Website at any time. The products will be invoiced at the price reflected on the Website at the time of registration of the order.
5. Product payment
Payment of the price of the goods purchased, including shipping costs, may be made by credit or debit card through the Stripe payment platform, by cash on delivery and by bank transfer as payment systems indicated at all times on the Website.
To proceed with the payment, the User must follow the instructions that appear on the screen depending on the chosen payment system.
6. Product delivery
Delivery will be made to the address indicated for this purpose in the EL MOLÍ DELS TORMS SL Online Shop; products will not be delivered to post office boxes.
During delivery, if you are not at home, the transportation company will contact you to arrange a second delivery.
EL MOLÍ DELS TORMS SL shall not be liable for any errors or damages caused in the delivery when the delivery address provided by the user does not match the place of delivery desired by the user.
EL MOLÍ DELS TORMS SL will indicate the delivery time of the purchase after confirmation of the order or if there is any incident that may delay the expected delivery. If the delay in delivery is greater than the maximum delivery period foreseen in this section, the customer may cancel the order totally or partially without cost.
The products purchased by the User will be delivered as soon as possible, and in any case, within the period of:
Mainland Spain and Balearic Islands: three (3) to five (5) working days from the date of order confirmation.
Other destinations: five (5) to ten (10) working days from the date of order confirmation.
Delivery service to the Canary Islands, Ceuta and Melilla is not currently available.
7. Product refund
(i) Right of withdrawal
In accordance with the provisions of Royal Legislative Decree 1/2007 of 16 November, which approves the Consolidated Text of the General Law for the Defence of Consumers and Users, the customer has a period of fourteen calendar days from receipt of the goods to withdraw from the contract.
To exercise the right of withdrawal, you must notify us of your decision to withdraw from the contract by means of an unequivocal statement (for example, a letter sent by post, fax or email). You may use the model withdrawal form below, but its use is not compulsory.
In order to meet the withdrawal deadline, it is sufficient that the communication concerning your exercise of this right is sent before the expiry of the withdrawal period.
Consequences of withdrawal:
In the event of withdrawal by you, we will reimburse to you all payments received from you, including the costs of delivery (with the exception of any additional costs resulting from your choice of a delivery option other than the least expensive standard delivery option offered by us) without undue delay and in any event not later than 14 calendar days from the date on which we are informed of your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment used by you for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any charges as a result of the reimbursement. We may withhold reimbursement until we have received the goods back, or until you have provided proof of return of the goods, whichever is the earliest.
You must return or deliver the goods directly to us at EL MOLÍ DELS TORMS SL, Carrer Mestre Benet, 19 -25164 – Els Torms (Lleida), without undue delay and, in any event, no later than 14 calendar days from the date on which you inform us of your decision to withdraw from the contract. The deadline shall be deemed to have been met if you return the goods before this period has expired.
You shall bear the direct cost of returning the goods.
You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature and characteristics and where there is evidence that the goods have been unsealed, opened, tampered with or exposed to unsuitable conditions. Products must be returned properly protected, in their original packaging, in perfect condition for subsequent sale.
(ii) Refund of defective products
With the exception of the above, no exchanges or returns of our products are permitted unless you receive an erroneous or defective order. In the event that the order arrives damaged or broken, this must be stated on the delivery note. For any other incident, please contact us within 24 hours of receiving the order by calling +34973128362 or writing to info@olicatessen.com. We will proceed to make the refund or replacement (if applicable) as soon as possible within 15 days after you receive our confirmation email.
Without prejudice to any other rights that may apply, the User shall be entitled to a refund of the price of the defective products or of the products delivered if they do not correspond to the order placed by the User. Alternatively, the User shall have the right to claim, and be delivered, an equal product, in perfect condition.
In the event of the return to EL MOLÍ DELS TORMS SL of defective products or products that do not correspond to the order, this must be carried out by the User through the procedure established in section (i) above, although the User, in this case, shall not be liable for the costs of returning said products.
Provided that the User has followed the procedure set out in section (i) above and the requirements set out in this section have been met, EL MOLÍ DELS TORMS SL will refund the price paid for returned products that are defective or do not correspond to the product order placed by the User, as set out in section (iii) below.
(iii) Reimbursement of the price of the products to the User
Provided that the User has followed the procedure set out in this section and the requirements set out therein have been met, EL MOLÍ DELS TORMS SL will refund the price paid by the User for the products returned. In the event that the return is made in exercise of the User’s right of withdrawal described in section (i) EL MOLÍ DELS TORMS SL will not pay or meet the expenses and/or costs of return.
The User shall not be entitled to reimbursement of the price of returned products that are not in the same condition in which they were delivered, or that have not met the requirements set out in these General Conditions.
Partial returns of an order will give rise to the reimbursement of the price corresponding to the product or products actually returned.
EL MOLÍ DELS TORMS SL will process the price refund order using the same payment system used by the User to purchase the products, within fourteen (14) days from the collection of the returned order and once EL MOLÍ DELS TORMS SL has checked that the products being returned meet the requirements established in sections (i) and (ii) above.

8. Modification of the General Conditions
EL MOLÍ DELS TORMS SL reserves the right to modify, at any time and without prior notice, the presentation and configuration of the Website, as well as the General Conditions. Users will always have these General Conditions in a visible place, freely accessible for any queries they may wish to make. Users undertake to read these General Conditions carefully each time they access the Website shop. In any case, the acceptance of the General Conditions will be a prior and indispensable step to the contracting of any product available through the Website.
9. Communications between EL MOLÍ DELS TORMS SL and the User
All communications between EL MOLÍ DELS TORMS SL and the User relating to these General Conditions or to the acquisition of products through the Website shall be made in writing and in accordance with the communication procedures established in these General Conditions for each particular case. For all other cases that are not expressly regulated in these General Conditions, the communications that the User intends to send to EL MOLÍ DELS TORMS SL shall be sent to the address of EL MOLÍ DELS TORMS SL indicated in Condition One and shall be made in writing and by means of a system that allows accreditation of the content and receipt by EL MOLÍ DELS TORMS SL of the corresponding communication.
10. Integrity of the General Conditions
These General Conditions, the Privacy Policy and the Legal Notice constitute the express and sole will of EL MOLÍ DELS TORMS SL and the User in relation to their object and invalidate and replace any other agreements or contracts, verbal or in writing, reached by the parties beforehand.
11. Partial invalidity
In the event that any Clause of these General Conditions is declared null and void, it will be withdrawn or replaced. In any case, such declaration of invalidity shall not affect the validity of the remaining provisions of these General Terms and Conditions.
